Basics of a Contempt of Court Scenario
If a party to a divorce fails to satisfy a court order (i.e., violating a restraining order, failing to pay child support or alimony, failing to fulfill timesharing or custody obligations, preventing the other spouse from performing their obligations, etc.), they could be found in “contempt of court.”
Contempt of court is not always straightforward, however. In order to successfully prove that a party is in contempt of a court order, the other party must show that:

- The party in contempt knew about the court order
- The party in contempt was able to comply with the court order (i.e., had sufficient funds to pay alimony)
- The party in contempt willfully violated the court order
- Enforcing the court order associated with the failed obligation will require the filing of a contempt action with the court.
